A request for collective action filed against Apple in Quebec

Apple has recently admitted to have slowed the performance of certain iPhone to save battery power of the devices.

Two law firms in Quebec have filed in the superior Court on the 29th of last December a request for collective action against the Apple company, arguing that the warranty terms of the products of the american giant violation of the Law on the protection of the Quebec consumer.


The request of the firms in LPC Lawyers and Renno Vathilakis Lawyers was filed after Apple acknowledged that it had slowed the performance of certain iPhone. The company has also allowed the limits of duration of battery life of the devices.


The lawyers claim that the period of one-year warranty offered to consumers in québec for the batteries is not a reasonable time given the price paid and intended use. In their opinion, the extended warranty “AppleCare” is not more advantageous than the legal warranty under the law, and its price is disproportionate to the point of causing injury objective to all purchasers of the AppleCare protection plan.


The application has been filed on behalf of consumers of Quebec registered in the collective action who have purchased an Apple product including an iPhone, an Apple Watch, an iPad, an iPod or a MacBook. It also includes those who have bought “AppleCare protection plan” or “AppleCare+” for an Apple product and who were not informed of the legal guarantee.


The application of class action seeks compensatory damages in an amount to be determined, as well as punitive damages in the amount of $ 300 per person. A hearing could take place in the coming months.
