After having been acquitted of a charge of obtaining the sexual services of a teenager, Sébastien Gagnon has been sentenced to a year in prison for having sexual relations with a person under the age of 16 years.
On the 12th of October at the Palace of justice of Rouyn-Noranda, Gagnon has recorded a plea of guilty to seven counts, one of sexual contact on a child victim, a threat of damaging a cell in the position of the Sûreté du Québec and five broken promises handed to a judge or to a peace officer.

As the Crown had no evidence to offer for the charges of obtaining the sexual services of a teenager, incitement to sexual touching and forcible confinement of a child victim as well as of drug trafficking leveled against him since may 30, 2016, Gagnon was acquitted.
No constraints, but not of the legal age
The main folder to which the man, 27-year-old has pleaded guilty to, was referring to actions that took place from 1 June to 30 September 2015. He was then 25 years old, while the victim was 15.
“The accused and the victim, which he was close to, met on an almost daily basis. There have been reconciliations, including massage, which led to gestures of a sexual nature and, finally, intercourse. There have also been a consumer of cannabis and methamphetamine. The victim has never been forced, but she had not the legal age of consent. When his parents found out what was happening, there has been a complaint,” said the Crown prosecutor, Me Melanie Won.
Counsel for Gagnon, Me Nathalie Samson, has noted that his client had no history of judicial in the matter and that he had provided a statement incriminating. “Although it is partial, it is possible to read Mr. allege that he and the victim had fallen in love,” she reported.
The other offences are related to the four events that occurred on the 29th of April, 20 June, 9 July and 16 July 2017. In any case, Gagnon had been arrested either because he consumed alcohol while he was supposed to refrain from doing so since his indictment for the gestures of a sexual nature, either because it had not complied with a curfew mandatory.
Mandatory minimum sentence
The Crown and the defence have recommended the imposition of a sentence of 392 days ‘ imprisonment. As Gagnon was kept in preventive detention since September 22, to have left after only 21 days of therapy closed six months to adjust the problem of consumption of drugs, the time spent behind bars was subtracted from the total, at a rate of one and one-half. It was therefore 365 days to be served, the mandatory minimum sentence for sexual interference on a child victim.
“You had 25 years old, and she was 15. You have seduced, she has fallen under your charm and you have benefited. And on several occasions. You have betrayed the trust of his parents. In addition, it gives you freedom, there, too, on several occasions, and each time, you are unable to meet conditions yet simple. You obviously have a low level of awareness in the face of the judicial system”, has launched the judge Marc E. Grimard at the location of Gagnon.
The magistrate, however, accepted the suggestion of the two lawyers. In addition to the prison sentence, Gagnon will have their name listed for a period of 20 years in the national sex offender Registry. He will also have to undergo a probation of two years.
“What plays in your favour is your guilty plea, which avoids the victim to undergo the ordeal of a trial,” stressed the judge Grimard. However, had it not been for the suggestion that common, you’d been in jail a lot longer. I hope that you will enjoy your time in detention to think about your future. At 27 years of age, it is not too late.”
