The conviction of a repeat offender of the violence, on 12 October at the Palace of justice of Rouyn-Noranda, has given rise to an exchange unusual between him and the judge Marc E. Grimard.
Represented by Me Marc Lemay, Sébastien Artano has pleaded guilty to counts of assault and threats of death or bodily harm, or to the place of his partner of that time, of breaking a promise made to a peace officer.
“For the first event, which took place from 1 march to 31 October 2015, one speaks of the wrangling continued in the course of which Mr. clung to his wife and was pushing in the walls. The latter lived for a bad pass during which she attempted suicide. It has been a very difficult period for the couple” told Me Lemay.
The other event took place on January 9, 2016, when Artano called the victim to persuade her to withdraw her complaint. “As she refused, he threatened, then went where she dwelt with her children,” said the lawyer.
By mutual agreement, both parties have suggested a three-year probation and a $ 3,000 donation from the organization Alternative to them, payable within a period of 30 months due to the financial situation of Artano. Along with the victim surcharge mandatory of 30 %, to be paid within a period of 12 months.
“It is the accused a repeat offender in cases of domestic violence, Mr. having been convicted by 2015 for threats launched in 2014, another joint,” said the Crown prosecutor, Me Melanie Won. Artano was given a probation of one year and a fine of $ 300 to be paid within a period of 12 months.
“I’m not lucky”
“You have trouble with your joint”, began the judge Grimard to the place of Artano. What he said: “I’m not lucky”. After a few seconds of silence, the judge resumed: “You have a problem with aggression, don’t you think?”. “I don’t think so, no,” replied Artano.
Before accepting the suggestion common of the two lawyers, the judge Marc E. Grimard has served another message to the accused: “You now have a new joint. I hope for you that it’s going to get better this time”.
