District administrative court of Kyiv has granted the lawsuit of the head of Department of special investigations of the GPU Sergey Gorbatyuk to the attorney General concerning the verification of a reformed Department of special investigations of the Prosecutor General. About it reports a press-service of the court.
Gorbatyuk asks the court to declare illegal actions of the Prosecutor General on the appointment of inspection organization of work in the Department of special investigation. In addition, he asks to cancel the corresponding order of the public Prosecutor.
Now the court solves a question on opening of proceedings in the case.
The head of the Department of special investigations of the GPU Sergey Gorbatyuk explained why he went to court.
“The lawsuit is really filed me regarding the cancellation of the decree of the Prosecutor General on the audit of the Department of special investigations and the recognition of actions unlawful. Regulatory documents of the Prosecutor General … to determine the conditions under which the check is appointed, namely the deficiencies in the work that are not resolved. That is, systemic flaws. Such deficiencies until the audit work has not been determined by the attorney General, respectively, of the grounds for the appointment was not” – said Gorbatyuk.
He suggested that the test appointed to find faults for the following – perhaps some kind of dismissal.
“Appeal to the General Prosecutor nor to no avail, accordingly, that the court asked that the court clearly accents in this situation”, – said the head of the office of special investigations of the GPU.
We will remind, earlier Prosecutor General Yury Lutsenko eliminated the Department of special investigations, moving from the staff of its leader, Gorbatyuk.
Note, this Department conducted several high-profile cases, in particular regarding crimes on the Maidan in 2014, and the usurpation of power by Viktor Yanukovych and his entourage. What Lutsenko assures that neither an investigator nor a Prosecutor in the Affairs of the Maidan “has not changed and does not resign”.
