The Verkhovna Rada re-considering proposals of the President issued law No. 5495, which provides for the increase of responsibility for illegal export from Ukraine timber and timber products. “For” vote of 246 people’s deputies. The President vetoed the document explaining that the proposed ban to 8 years in the export of fuel wood contrary to the international obligations of Ukraine, so this rule was withdrawn.

The Criminal code of Ukraine will be a new article No. 201-1 on the illegal export of timber (in particular unprocessed), lumber valuable and rare tree species. Smuggling of these goods will entail responsibility in the form of imprisonment from 3 to 5 years. If a person has committed such a crime is not the first time or in a large size – it will be threatened by imprisonment from 5 to 10 years, confiscation of property and deprivation of the right to occupy certain positions to 3 years.
If the crime was committed by an organized group or talking about smuggling in especially large size, the punishment is imprisonment from 10 to 12 years with deprivation of the right to practice certain activities for up to 3 years and confiscation of property.
Previously, illegal felling of forests provided for a fine of 850-1700 UAH, or arrest up to six months, or restriction/deprivation of liberty for a term up to 3 years.
Updated article prescribes punishment not only for lumbering but also for illegal transportation, storage or marketing of timber.
So, illegal felling of trees in forests or other plantations; transportation, storage, sale of illegally cut trees or shrubs, causing significant damage, shall be punished by a fine of 17 thousand to 25,5 thousand UAH or arrest for up to six months, or by restriction or deprivation of liberty up to 3 years. Repeated violation of or conspiring group of individuals will provide punishment in the form of restriction or deprivation of liberty up to 3 years.
If you illegally cut down trees in the reserves or in the territories of natural reserve Fund – we are talking about a fine of 25, 5 thousand UAH to 34 thousand UAH or restriction/deprivation of liberty for up to 5 years. If the violation resulted in serious consequences (loss of 85 thousand UAH) is provided for imprisonment for 5-7 years.
The law also provides for increased penalties for damage to forests.
Illegal logging, damage and destruction of wood cultures and young growth may be cause for penalty 255-510 UAH for nationals (formerly 85-170 UAH) and UAH 1275-2550 for officers (previously – UAH 119-204). The same (increased) the penalties provided for the unlawful transportation or storage of felled trees and shrubs.
For a second violation within a year – penalty 510-1020 UAH for citizens and 5100-10200 for officials.
Damage to forests by sewage, chemicals, petroleum products and harmful emissions can cost 510-1530 UAH for citizens and 2550-4250 UAH for officials (formerly 170-510 UAH for citizens and 510-850 UAH for officials).
Fine 170-510 for citizens and 510-850 UAH for officials is expected not only for the damage to plantations in the settlements but also outside them.
The law will come into force on 1 January 2019.
Recall, the Verkhovna Rada adopted the law in General in July 2018, but the President of Ukraine Petro Poroshenko has vetoed the document.
