Press Secretary of the Prosecutor General Andrei Lysenko on his page in Facebook explained why in Russia extradited the Ingush Timur Tumgoev.
According to him, first, “the competent authorities of the Russian Federation” has sent a request for the extradition of persons for bringing to criminal liability for committing crimes under part 2 of article 208, article 205.3 and part 2 of article 205.5 of the criminal code of the Russian Federation, namely: the training in order to carry out terrorist activities and participation in a terrorist organization.
Russia accuses Tumgoev participation in an illegal armed formation, which structurally was part of the group “Islamic state” and participated in the fighting against government forces of the Syrian Arab Republic. According to him, he did not hide this fact. That is why the Prosecutor General on 13 October adopted a decision on the results Tumgoev, which appealed this decision.
“The complaint on the decision of the Prosecutor General of Ukraine on extradition was denied by the courts of first instance and appeal. That is, the decision of the Prosecutor General of Ukraine on extradition entered into force”, – wrote to Lysenko.
He also said that Tumgoev twice (2016 and 2017) appealed to the migration service authorities with an application for refugee status, but he refused.
“That is, a person fully used their right for seeking protection on the territory of Ukraine, however, grounds for granting refugee status have not been established”, – said the speaker.
The European court of human rights has also considered the treatment Tumgoev on the adoption of measures to suspend extradition proceedings in the Russian Federation. The Prosecutor General’s office was provided all the requested documents, after learning that the European court had abolished all restrictive measures.
“That is the European court of justice was not established obstacles for consideration of Ukraine’s request for extradition of the said person,” – said Lysenko.
Also, the representative of the Prosecutor General argues that Tumgoev did not participate in ATO.
“It should also be noted that “positive image” Tumgoev in the press are trying to create due to the spread information about its participation in the Antiterrorist operation in the East of Ukraine. However, during the consideration of the General Prosecutor’s office request for his extradition (over two years) any data about the persons involved in the ATO or the desire to participate in the ATO did not, even once, it was the defense,” concluded Lysenko.
Recall that on 12 September it became known that the Prosecutor General’s office extradited to the Russian Federation of Ingush Timur Tumgoev at the request of the Federal security service of Russia.
